  • Convention and Code Doubts

Hi guys, could someone please help me out with some doubts?

1- Can a state member accept only part of a convention? or when they agree and sign it, it is mandatory that they should follow it all up?
2- Is it necesary to bring the rules of a conventions into a country's law to be considered legal or, when our state member signs it, it is already mandatoy in all national territory ?
3- Does every code needs to be specified by a convention?

    Thx!

It will depend on the type of convention. For e.g. POLAR code all the ships are not required to enforce this if they are not plying to the Arctic. Whatever they sign, they need to comply.

If you are a signed party of the convention, then the local Law cannot be lesser stringent than the signed convention (it can be more tougher though). It is mandatory inside the national territory.

    3. Does every code needs to be specified by a convention?
Yes. It provides the international standards required for the elements mentioned in that particular chapter of the convention.
